The EFF leader Julius Malema has been given a 5-year direct imprisonment in his firearm discharge case.
But he has immediately applied for an appeal against his convictions.
After hearing submissions from both the state and the defense. The Magistrate said in her ruling that she stands by her earlier conviction decision.
Olivier approved the appeal against the five-year sentence adding that the higher Court could reach a different decision, also saying that the court does not have intentions of standing in the way of such possibility.
Malema will remain out on bail until the appeal process runs its course.
