Every parent in South Africa, irrespective of gender, colour or circumstances, is now entitled to a 4 months and 10 days of parental leave, promoting equality and flexibility in childcare responsibilities.

The Constitutional Court has unanimously confirmed that the maternity and paternity leave provisions in the Basic Conditions of Employment Act (BCEA), and the Unemployment Insurance Fund (UIF) Act are unconstitutional and invalid.

The court ruled that disparity in parental leave entitlements between mothers and fathers is unfair and unconstitutional.
